Creation of the Federal constitutional court

The court will:
•Be headed by a Chief Justice and additional judges as determined by Parliament or—temporarily—the President.


•Have equal provincial representation, ensuring no single region dominates constitutional interpretation.


•Include at least one judge from the Islamabad High Court, though Islamabad’s representation cannot exceed that of any province.


This structure aims to decentralize judicial power and balance regional influence within constitutional adjudication.

Shifting constitutional jurisdiction from Supreme Court to FCC

A series of articles have been amended to transfer select constitutional functions to the new FCC.

•Article 17(2): Political party regulations now fall under the FCC.


•Articles 63A(5), 68, 100 & 114: Major constitutional interpretations redirected to the FCC.


•Articles 152, 159, 165A, 168: Financial, administrative, and tax-related reviews updated.


The Supreme Court now primarily handles appellate matters, while the FCC becomes the central authority for constitutional interpretation—a structural overhaul unmatched since Pakistan’s early constitutional formation.

Reforming judicial appointments

Article 175A undergoes profound reform, redefining how judges are nominated and evaluated.
Major Revisions Include:
1. Dual leadership in the Judicial Commission: The Chief Justice of the FCC and the Chief Justice of the Supreme Court will co-lead, replacing the former single-authority structure.


2.Expanded commission membership:
The commission now includes balanced senior judges from both courts and introduces a new Speaker-nominated member—either a woman, non-Muslim, or technocrat—to promote inclusivity.


3.Clarified eligibility and seniority rules:
New guidelines govern the ranking of judges transitioning between courts.


4.Mandatory interviews for nominees:
A new interview requirement ensures deeper assessment of judicial candidates.


5.Transitional appointment of first FCC Chief Justice:
The President, advised by the Prime Minister, will appoint the inaugural Chief Justice from among Supreme Court judges.

Changes to parliamentary and executive structures

Beyond judicial reform, the amendment clarifies several political procedures.


Key adjustments include:
•Article 59: All Senate terms now end uniformly on 11 March.


•Article 105: Governors must act per Articles 224 and 224A during caretaker appointments.


•Article 130: Provincial cabinets may now expand in size for improved administrative capacity.


These changes aim to eliminate ambiguity in governance transitions and strengthen political stability.

Financial and administrative revisions

Several constitutional finance-related articles receive major updates:


•Article 42: The presidential oath now includes explicit reference to the FCC.


•Articles 78 & 81: Consolidated Fund oversight now incorporates FCC review.


•Article 165A: Tax matters fall under strengthened judicial scrutiny.


•Article 168: The Auditor General’s appointment requires consultation with the Supreme Court.
