Court upholds Rivers state emergency declaration, dismisses three lawsuits

Federal High Court dismisses challenges to Rivers State emergency declaration, affirming presidential powers, jurisdiction limits, and legality of sole administrator appointment.

The Federal High Court in Abuja has affirmed the legality of the Rivers State emergency declaration, dismissing three separate lawsuits that questioned the suspension of elected officials and the appointment of a sole administrator.

Justice James Omotosho ruled that the plaintiffs lacked the right to sue and that the Federal High Court had no jurisdiction to hear disputes arising from a state of emergency.

The first suit, filed by a group of Rivers residents, argued that the suspension of Governor Siminalayi Fubara, his deputy, and lawmakers was unconstitutional.

They also challenged the role of retired Vice Admiral Ibok-Ete Ibas, appointed as sole administrator under the emergency rule.

Justice Omotosho, however, held that only the Supreme Court has the authority to handle matters tied directly to a Rivers State emergency declaration.

He added that the plaintiffs could not sue on behalf of all citizens, nor replace the officials who were directly affected but had not filed the case themselves.

In his detailed ruling, Justice Omotosho explained that the Nigerian Constitution, particularly Section 305, grants the President wide powers to declare a state of emergency whenever peace and public order are under threat.

He said the situation in Rivers created “reasonable grounds” for such action and noted that the suspension of officials was temporary rather than permanent removal.

He further stated that appointing a sole administrator was a constitutional measure to stabilize the state until conditions returned to normal.

This reinforced the position that the Rivers State emergency declaration was made within the lawful discretion of the President.

Two additional cases, brought by civic groups Rivsbridge Peace Initiative and Pilex Centre for Civic Education Initiative with Courage Nsirimovu, challenged the administrator’s control of state funds and his authority over local government appointments.

Both were struck out on the grounds of lack of locus standi and jurisdiction.

Justice Omotosho stressed that civic groups cannot assume powers meant for elected officials and warned that the Federal High Court cannot overstep into areas reserved for the Supreme Court.

The judge also criticized the lawyers who filed the cases, accusing them of poor research and wasting judicial time with claims “void from the start.”

He cautioned against using the courts for political battles or public spectacle, emphasizing that emergency declarations require careful legal scrutiny, not hurried applications.

By upholding the Rivers State emergency declaration, the Federal High Court has reinforced the President’s constitutional authority to act decisively in times of crisis.

The ruling also sets a precedent for future disputes, reminding litigants that only the Supreme Court can hear such matters and that standing must be clearly established.

For Rivers State, the decision means that the sole administrator remains in control until the emergency period ends, while suspended officials wait for the restoration of normal governance.

The dismissal of these cases not only validates the Rivers State emergency declaration but also strengthens constitutional order by clarifying the limits of judicial intervention in emergency situations.

It underlines the importance of stability, legal procedure, and the rule of law in managing state crises.
