Local government reform bill seeks four-year tenure for councils nationwide

Nigeria’s local government reform proposal seeks to standardise tenure, curb governors’ powers, and strengthen accountability at the grassroots level.

Nigeria’s long-standing debate over the autonomy, stability, and effectiveness of local governments has taken a significant turn with a new local government reform proposal currently before the National Assembly.

Local government reform

The initiative, developed as part of an ongoing constitutional review, aims to standardise tenure, redefine eligibility criteria, and limit the influence of state governors over elected councils.

For decades, local governments have been widely regarded as the weakest tier of governance in Nigeria, often hampered by inconsistent tenure arrangements, political interference, and weak accountability mechanisms.

The new proposals seek to address these challenges by entrenching clearer constitutional safeguards and promoting democratic continuity at the grassroots level.

Background to the Constitutional Review

The proposals emerged from deliberations of the joint Constitution Review Committee of the Senate and the House of Representatives, which recently adopted a wide range of recommendations at a retreat in Lagos.

These recommendations form part of 44 constitutional alteration bills currently awaiting consideration by both chambers of the National Assembly.

Lawmakers initially planned to vote on the bills before the Christmas and New Year recess.

However, members of the House of Representatives requested additional time to study the recommendations in detail and consult with their constituents, given the far-reaching implications of the reforms.

If approved by the National Assembly, the bills will be forwarded to the 36 State Houses of Assembly for concurrence before being transmitted to the President for assent, in line with constitutional requirements.

Uniform Tenure as the Core of the Reform

At the heart of the local government reform proposal is the introduction of a uniform four-year renewable tenure for elected local government chairmen and vice chairmen across Nigeria. Currently, tenure lengths vary widely, with many states operating two- or three-year terms.

Only the six Area Councils in the Federal Capital Territory presently enjoy a four-year tenure, making the proposed reform a major step toward nationwide standardisation.

Advocates argue that a fixed tenure will promote stability, allow for better planning, and reduce the constant cycle of elections and dissolutions that disrupt governance at the local level.

Under the proposed amendment to Section 212 of the Constitution, a chairman would remain in office until a successor is sworn in, or until death, resignation, or lawful removal occurs.

The four-year term would commence from the date the official takes the Oath of Allegiance and oath of office.

Provisions for Exceptional Circumstances

The proposal also anticipates extraordinary national situations. In the event that Nigeria is physically involved in a war and elections cannot be reasonably conducted, the National Assembly would be empowered to extend the four-year tenure in increments of up to six months.

Such extensions, however, would be subject to legislative approval and could not exceed six months at a time.

Additionally, where a rerun election occurs and the previously sworn-in chairman emerges victorious, the time already spent in office prior to the annulment would be counted as part of the four-year term.

This provision is designed to prevent manipulation of tenure through prolonged legal disputes.

Eligibility Requirements for Candidates

Another significant aspect of the local government reform relates to eligibility criteria for chairmanship candidates.

The proposal sets a minimum age of 25 years and requires candidates to possess at least a school certificate or its equivalent.

In addition, aspirants must be members of a political party and must be sponsored by that party to contest elections.

Supporters argue that these requirements strike a balance between inclusivity and basic educational competence, while critics contend that the educational threshold remains too low for effective leadership.

Reducing the Powers of State Governors

One of the most consequential elements of the reform is the removal of state governors’ powers to dissolve elected local government councils.

Historically, governors have exercised significant control over local governments, often dissolving councils and replacing them with caretaker committees.

Under the new framework, the removal of a chairman or vice chairman would be handled strictly by the local government legislative council, following a clearly defined constitutional process.

This shift is widely seen as a major step toward strengthening local government autonomy and insulating grassroots governance from excessive state interference.

Removal Process and Accountability Mechanisms

The local government reform proposal lays out a detailed procedure for removing an elected chairman or vice chairman on grounds of gross misconduct.

The process begins with a written notice signed by at least one-third of the members of the local government council.

Once the notice is submitted to the Speaker, copies must be served on the affected official and all council members within seven days.

The council then has fourteen days to decide, without debate, whether the allegations warrant investigation. A two-thirds majority is required for the motion to pass.

If approved, the Speaker requests the Chief Judge of the state to constitute a seven-member investigative panel composed of individuals of unquestionable integrity who are not affiliated with political parties, legislative bodies, or public service.

The accused official is entitled to legal representation and a fair hearing.

The panel must submit its report within three months. If the allegations are not proven, the matter is dismissed.

If proven, the council may adopt the report by a two-thirds majority, leading to the immediate removal of the office holder.

Legal Finality and Constitutional Privileges

In a controversial provision, the proposal states that the proceedings and decisions of the investigative panel and the local government legislative council cannot be questioned in any court.

While proponents argue this ensures swift resolution of political disputes, critics warn it may limit judicial oversight and access to redress.

The reform also extends constitutional privileges enjoyed by the President and state governors to elected local government chairmen and vice chairmen.

Furthermore, no chairman may assume office until assets and liabilities have been declared and the prescribed constitutional oaths taken.

Implications for Grassroots Governance

If implemented, the local government reform could mark a turning point in Nigeria’s democratic evolution.

By standardising tenure, strengthening accountability, and reducing state-level interference, the reforms aim to restore public confidence in local governance.

However, the success of the initiative will ultimately depend on political will, effective implementation, and the cooperation of state governments.

As the constitutional review process continues, Nigerians will be watching closely to see whether these proposed changes translate into meaningful improvements in service delivery and democratic participation at the grassroots level.
