Osun State files suit against FG over alleged refusal to release Local Government allocations, with Supreme Court review and hearing set for September 22, 2025

The Federal High Court in Abuja has set September 22, 2025, for the hearing of a suit filed by the Osun State Government challenging the Federal Government’s alleged refusal to release the state’s Local Government (LG) allocations.



The date was fixed by Justice Emeka Nwite on Monday, after legal representatives for all parties outlined several pending motions in the case.

Musibau Adetunbi (SAN), representing Osun’s Attorney General, Oluwole Jimi-Bada, told the court that his client had filed multiple motions.

The first challenges the court’s Chief Judge’s decision to transfer the case from the Osogbo division to Abuja.

The second seeks to discontinue the suit against the Attorney General of the Federation (AGF), who is listed as the third defendant.

In that motion, the Osun government said the AGF had, through an affidavit of urgency filed on August 13, indicated an intention to release Local Government funds to APC chairmen and councilors who, the state claims, were removed from office by court judgments.

The government stated this prompted its decision to pursue a separate case against the AGF at the Supreme Court, noting that the issues in the new suit overlap with those in the current trial.

The state also filed a motion on August 26 asking the court to pause further proceedings in the Abuja case until the Supreme Court hears its application, arguing that the AGF has refused to comply with existing appellate court rulings.

Responding, Akin Olujimi (SAN), counsel for the AGF, said his client had not been formally served with the discontinuance notice and suggested the court’s scheduled activities should proceed unless directed otherwise.

The Central Bank of Nigeria (CBN), represented by Muritala Abdulrasheed (SAN), clarified that it was the AGF who requested the case be fast-tracked to a vacation judge.

The CBN has filed seven sets of documents addressing both the stay of proceedings and the transfer of the case to Abuja.

Tajudeen Oladoja (SAN), representing the Accountant General of the Federation, urged the court to hear all pending motions at once, warning that failure to do so during the vacation period could render the exercise academic.

The Osun government is seeking to prevent the CBN from opening accounts for APC-elected chairmen of 2022, who, according to the state, were removed from office by valid court rulings.
