Elistan Kumagbo is guilty of two serious offences against children; one is a defilement of an 8-year-old girl and sexual assault by the penetration of a 4-year-old girl

Man Jailed for Defiling Neighbour’s Daughters- Elistan Kumagbo was found guilty and sentenced to life in prison on Wednesday by Justice Rahman Oshodi of the Lagos State Special Offences and Domestic Violence Court for the crime of defiling neighbor’s daughters, who were 8 years old and 4 years old, respectively.

After determining that the prosecution had established beyond any reasonable doubt the case of defilement and sexual assault by penetration that was filed against Kumagbo by the state, Justice Oshodi sentenced him to life in prison and ordered that his name be listed in the register of sexual offenders. It was also ordered that his name be registered in the register of sexual offenders.

On May 4, 2022, the individual entered a plea of not guilty after being convicted of the offenses committed on February 6, 2021, at 34 Olowolagba Street in Yaba, Lagos State.

After declaring that the two sisters who were the victims of the crimes provided thorough and confirming evidence through the course of the trial, Justice Oshodi decided to place the convicted individual in jail.

In addition, the judge looked at the convict’s confessional statement made at the police station during the investigation, as well as medical evidence that confirmed sexual assault. The judge also considered the convict’s oral confession to the survivor’s father.

The Judge declared, “Elistan Kumagbo, you have been found guilty of two serious offences against children; one is a defilement of an 8-year-old girl and sexual assault by the penetration of a 4-year-old girl.

“You exploited their vulnerability and betrayed the trust of their family; during the criminal trial, I heard evidence of how you repeatedly subjected these young girls to sexual abuse.

“You have shown no remorse for your actions; throughout your trial, you denied knowing these children. Section 137 of the Criminal Law prescribes life imprisonment, and Section 261 of the Criminal Law prescribes life imprisonment for sexual assault by penetration.

“Having considered the circumstances of these cases, I hereby sentence you as follows: count one, you’re sentenced to life imprisonment; on count two, you’re sentenced to life imprisonment. The sentences shall run concurrently.

Only one witness, the defendant himself, was summoned by the defense during the trial, while the prosecution called five witnesses to testify.

It was revealed to the court by the survivor’s father that the defendant was his brother, although they were not connected by blood. It was the same village from where they both originated.

Each and every time the father leaves for work, he always gives his children to the care of his neighbor. Iya-David, the defendant’s neighbor, informed him that the defendant had sexually abused his daughters when he arrived home on that fateful day. He also testified that the neighbor told him this.

Officer Adeyemi Oluremi of the Investigative Police Unit presented the medical records, the survivor’s statement, the father’s statement, and the prisoner’s statement.
